Public and Products Liability is considered to be one of the most important insurance covers for all businesses.

Public and Products Liability insurance is designed to protect you and your business from the significant costs associated with any legal action as a result of your actual or alleged negligence that has caused third party property damage or personal injury, whilst acting in the course of your business (including employees) or through your products.

Accidents can and do happen.

You have a duty of care to uphold to your customers, employees, and the general public. If deemed negligent, even without intent, compensation ordered payable to claimants can be substantial and potentially damaging to the financial position of your company.

Public and Products Liability insurance can cover you for:

  • amounts you are required to pay as a result of claims
  • compensation for third party personal injury and/or property damage, arising as a result of an occurrence in connection with your business
  • legal proceedings, including defence costs incurred to defend the claim
  • most Public and Products Liability insurance policies will also include liability for damage to property under your physical and legal control.

Cover provides for damage to a 3rd party’s goods held in your Care, Custody and Control.

Definition of Insured

Provides for a broad definition of insured to include directors, owners, employees and volunteers whilst carrying out the business of the Insured.

Territorial Limits

Cover includes Australia-wide but is often extended worldwide (excluding North America)

Potential to Extend Cover

Cover can be extended to include errors & omissions, statutory liability, recall expenses & environmental risk.

Yes, the definition of insured includes employees whilst carrying out your business.  The policy is not normally situation specific so as long as the insurer is aware of the activity your employees preform then cover should apply anywhere in Australia.

Yes, in principal it would, but your tenant would need to prove that the loss has incurred due to your negligence as the property owner.
